Upper Cut Co — Privacy Policy

Upper Cut Co is operated by Brad Grove, ABN 26 941 149 029, based in Currans Hill, NSW, Australia.

This Privacy Policy explains how Upper Cut Co handles personal information when you browse our website, contact us, request a quote, place an order, provide artwork or other material, or subscribe to marketing.

Personal information generally means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Privacy enquiries can be sent to contact.team@uppercutco.com.au or raised by calling 0432 395 486.

1. Information we collect

Depending on how you interact with Upper Cut Co, we may collect information including:

  • Your name, email address, phone number and billing or delivery address.

  • Order details, products purchased, payment status and transaction references.

  • Information required for quotes, invoices, delivery, returns, refunds or customer enquiries.

  • Account information if you create or use an account on our website.

  • Names, wording, images, photographs, logos, graphics and other files supplied for custom or personalised work.

  • Design approvals and correspondence relating to an order.

  • Gift-recipient details where you ask us to deliver a product to another person.

  • Marketing preferences and records of subscription, consent or unsubscribe requests.

  • Technical and usage information associated with website visits, such as IP address, device and browser information, pages viewed and website interactions.

Complete payment-card information is generally handled by the payment service selected at checkout rather than being provided directly to Upper Cut Co. We may receive transaction references, payment status and other information necessary to process, reconcile, refund or investigate a transaction.

We do not generally seek to collect sensitive personal information. Please do not provide passwords, complete payment-card details or unnecessary sensitive information through email, contact forms or custom-artwork uploads.

If sensitive information is provided unexpectedly, we will only retain, use or disclose it where reasonably necessary and permitted by applicable law.

2. How we collect information

We collect information directly when you:

  • Enter information on our website.

  • Contact us by email, telephone, social media or another communication channel.

  • Request a quote.

  • Place or manage an order.

  • Upload or provide artwork, photographs or other files.

  • Approve a custom design.

  • Subscribe to marketing.

  • Otherwise deal with Upper Cut Co.

We may also receive relevant information from payment providers, delivery providers, ecommerce platforms, marketplaces, accounting services and communication platforms that you use to interact or transact with us.

Website technologies may automatically collect technical and usage information, subject to their configuration, your cookie choices and applicable consent requirements.

If you provide another person's information, including a gift recipient's details or an image containing an identifiable person, you should ensure you have authority to provide that information for the intended purpose.

3. Why we use personal information

We may use personal information where reasonably necessary to:

  • Respond to enquiries and prepare quotes.

  • Process orders, payments, invoices and refunds.

  • Design, prepare, customise and manufacture approved products.

  • Communicate about artwork and obtain design approval.

  • Arrange delivery and provide order updates.

  • Assess faults, returns, complaints and consumer-guarantee enquiries.

  • Maintain accounting, taxation and other business records.

  • Detect fraud, protect our systems and resolve payment disputes.

  • Operate, secure and improve our website.

  • Understand website performance and customer experience.

  • Photograph or record our manufacturing processes and completed products and showcase our work as described in section 5.

  • Send marketing communications where permitted.

  • Meet legal and regulatory obligations.

  • Establish, exercise or defend legal claims.

If information necessary to fulfil an order is not provided, we may be unable to complete the purchase, customisation or delivery.

You can generally browse the website or make a general enquiry without providing your full identity where it is practical to do so.

4. Service providers and disclosure

We may provide relevant information to third parties where reasonably necessary to operate Upper Cut Co and provide products and services.

These may include:

  • Wix, which provides our website, ecommerce and related services.

  • Payment services available through our checkout.

  • Postal, courier and freight providers.

  • Accounting and invoicing services, including QuickBooks Online.

  • Email and communication services, including Microsoft services.

  • IT, hosting, security and data-storage providers.

  • Professional advisers where reasonably required.

  • Manufacturing, production or fulfilment contractors where their involvement is necessary for an agreed order.

  • Analytics, advertising and marketing providers where those services are enabled.

We aim to limit disclosure to information reasonably required for the relevant service. For example, a delivery provider requires recipient and delivery information, while a manufacturing contractor may require approved artwork and production specifications.

Payment providers may collect and process information under their own privacy policies and terms. Upper Cut Co receives information necessary to administer, reconcile and manage transactions.

We may disclose information where required or authorised by law, or where reasonably necessary to address suspected fraud, security incidents, payment disputes or legal proceedings.

Upper Cut Co does not sell or rent customer personal information or customer contact lists.

5. Custom products, artwork, photographs and promotional use

Upper Cut Co designs, manufactures, modifies and customises products, and documenting that work is an important part of our business.

We may photograph or record products during manufacturing, fabrication, customisation and after completion.

Unless you tell us before completion of your order that you want the project kept private, Upper Cut Co may use photographs or video of the completed product, including custom and personalised products, to showcase our products, workmanship and customisation capabilities.

This may include use on:

  • The Upper Cut Co website and product galleries.

  • Upper Cut Co social media accounts.

  • Portfolio and example-work galleries.

  • Organic social media posts, reels and videos.

  • Advertising and promotional material.

  • Printed promotional material.

  • Other Upper Cut Co marketing and business-development material.

We do not ordinarily seek separate permission each time we photograph or publish product-only imagery covered by this section.

If you do not want photographs or video of your custom order used publicly, tell us before production is completed and we will treat the order as private for promotional purposes.

We will take reasonable steps not to publish customer contact details, delivery information, payment information or other unrelated personal information when showcasing an order.

Additional permission may be sought where promotional use would involve an identifiable image of a customer or another person, a customer-supplied personal photograph, sensitive personal information, confidential material or other information for which separate permission is reasonably required.

If you tell us that a project is commercially confidential or subject to particular handling requirements, those requirements should be agreed with us before production.

If you later ask us to stop using previously published material, we will consider reasonable requests and can stop future use where appropriate. We cannot guarantee removal of material that has already been printed, distributed, independently shared, reposted, cached or otherwise copied by third parties.

Customer-supplied artwork, logos, photographs and other intellectual property remain subject to applicable intellectual-property rights and our Terms and Conditions. Nothing in this Privacy Policy gives a customer authority to grant rights that they do not legally hold.

6. Cookies, analytics and advertising

Our website uses cookies and similar technologies required to provide functions such as website security, shopping carts, member accounts, forms and checkout.

Additional cookies and similar technologies may be used for purposes including:

  • Website analytics.

  • Understanding visitor behaviour and website performance.

  • Advertising measurement.

  • Conversion tracking.

  • Audience measurement.

  • Personalised or targeted advertising where permitted.

Depending on the integrations enabled on our website, these services may include Wix analytics services and services provided by advertising or analytics platforms such as Google or Meta.

The specific cookies, technologies and third-party services active on the website may change as we update our website and marketing systems.

Our website provides cookie controls that allow visitors to manage available categories of non-essential cookies. Cookies may also be managed through browser settings.

Where consent is required for non-essential cookies or tracking technologies, those technologies are subject to the consent choices made through our website.

Viewing this Privacy Policy or simply continuing to browse our website is not treated as blanket consent for every type of tracking or use of personal information.

Blocking essential cookies may prevent some website, shopping-cart, account or checkout functions from operating correctly.

7. Marketing communications

Upper Cut Co may send promotional email or SMS where we have the consent or other permission required under applicable law.

Our commercial electronic messages identify Upper Cut Co and provide a way to unsubscribe.

Making a purchase or providing information necessary to complete or deliver an order does not, by itself, automatically subscribe you to ongoing promotional marketing.

You can unsubscribe using the option provided in a marketing message or by contacting us.

We action unsubscribe requests within 5 working days and do not charge a fee for unsubscribing.

Unsubscribing from promotional marketing does not prevent us from sending communications reasonably necessary to manage an existing order, payment, enquiry, product-safety matter, consumer-guarantee claim or other existing business relationship.

8. Storage and overseas service providers

Upper Cut Co uses third-party technology and service providers to operate the business.

Some providers operate internationally, and personal information may therefore be stored, processed, transmitted or accessed in Australia and overseas.

Depending on the service and provider configuration, overseas processing or access may occur in the United States and other countries in which our website, ecommerce, accounting, email, payment, analytics, advertising, security or technology providers operate.

The location of processing can change as providers change infrastructure, service arrangements or subcontractors.

Where reasonably practicable, we consider information published by our service providers about data handling, security and international processing when selecting and using those services.

Where applicable law requires safeguards in connection with an overseas disclosure, we take reasonable steps to meet those requirements.

Acceptance of this Privacy Policy is not intended to waive any privacy protections that otherwise apply to you.

9. Security and retention

We take reasonable steps to protect personal information against loss, misuse, interference, unauthorised access, modification or unauthorised disclosure.

Information may be held electronically through the business systems, services and devices used to operate Upper Cut Co.

No online or electronic system can be guaranteed to be completely secure.

If we become aware of a security incident involving personal information, we will assess the circumstances, take appropriate steps to contain or address the incident and make notifications where required by applicable law.

We retain information for as long as reasonably necessary for the purposes for which it was collected or subsequently required, including:

  • Fulfilling orders and providing customer support.

  • Maintaining accounting and taxation records.

  • Managing product or consumer-guarantee enquiries.

  • Maintaining evidence of custom designs and customer approvals.

  • Preventing or resolving disputes.

  • Meeting legal requirements.

When personal information is no longer reasonably required and does not need to be retained by law or for a legitimate business purpose, we take reasonable steps to delete or de-identify it.

10. Access, correction and deletion requests

You can contact Upper Cut Co to:

  • Request access to personal information we hold about you.

  • Ask us to correct information you believe is inaccurate or out of date.

  • Ask us to delete information that is no longer reasonably required.

We may need to reasonably verify your identity before providing access to or changing personal information.

Please do not send identity documents unless we explain why they are required and provide an appropriate method for supplying them.

Some information may need to be retained for taxation, accounting, order records, consumer-guarantee matters, legal obligations, fraud prevention or dispute resolution.

If we cannot fulfil a request in whole or in part, we will explain the reason where appropriate and provide information about any available complaint or review process.

11. Third-party websites and platforms

Our website and communications may contain links to third-party websites, payment services, social media platforms or other external services.

Those services may collect and handle personal information under their own privacy policies and terms.

Upper Cut Co does not control the privacy practices of unrelated third parties simply because our website links to or integrates with their service.

You should review the relevant provider's privacy information if you want to understand how that provider handles your information.

12. Privacy complaints

Privacy enquiries or complaints can be sent to:

Email: contact.team@uppercutco.com.au
Phone: 0432 395 486

Please provide enough information for us to understand and investigate the matter.

We aim to respond to privacy complaints within 30 calendar days. If additional time is reasonably required, we will explain the reason and provide an update.

Depending on the law applying to your circumstances and to Upper Cut Co, you may also be able to seek assistance from the Office of the Australian Information Commissioner or another appropriate regulator.

Nothing in this Privacy Policy limits rights that apply under privacy, consumer or other applicable law.

13. Changes to this Privacy Policy

We may update this Privacy Policy when our business practices, services, technology or legal obligations change.

The latest version will be made available through our website.

A change to this Privacy Policy does not, by itself, authorise a materially different use of personal information already collected where additional notice or consent is required by applicable law.
